Mixed decision. Kills transferring the money from school accounts but does claim money so transferred would not be state funds and could go to sectarian institutions.

Big problem is they now have to find a source of taxes to pay for it. And tax increases to help the well off generally don't do well..

Raise taxes so affluent families can subsidize private school tuition. Good luck with that. It would take a two-thirds vote, too.

How popular is the program? Could a state constitutional amendment be pushed through to override the court decision? Or does no one, or at least not enough people, care?

Sandoval's statement after the ruling makes it seem like he will not call a special session pertaining to ESAs.

Edit to reply to post added: The issue was not that the ESAs themselves are unconstitutional, it is that they were not funded properly. There would be little reason to go the constitutional amendment route. That would take four to six years as it must pass the Legislature in two separate sessions and a public referendum. The Legislature can raise taxes/create a new tax with a two-thirds vote. They would at least try to go that route first.

One could argue there is a way to revise the budget to fix this. If that is a valid argument, that would only take a majority but isn't going to have a chance to happen until 2017 for funding of 2018.

I suspect that the Legislature will not try to find a backdoor, only to get defeated again. If they are going to fix this, they will do it the right way to make it air tight.

FWIW the loophole they found works, according to the court's opinion. Once that money goes to the student's family, it can go anywhere, even to a religious organization. The negative ruling only applied to the funding source.

This is a sad defeat for the Right Wing. They got a majority in the legislature for the first time in years and likely last time ever. There is no significant support except on the right. And it was one of those gut issues..."we really socked it to them" Gleen Cook of the RJ practically preened like a fighting **** each time he wrote about it.

Any new taxes will require a 2/3 vote which is not going to happen.

And it is very unlikely the Republicans will maintain control of either house. Their hope is only in off year elections.
