PERSONAL opinion only , I think miranda is a hunkahooie....theres not a person walking in the USA that doesnt know those rights......government interference where none is needed ....

Another misconception-- the police do not need to read Miranda when they arrest you-- only if you are in custody and they are interrogating you. If you spontaneously say something incriminating in the back of the police car and think it can't be used against you, you are wrong-- unless it was the result of questioning, Miranda is not necessary. I'm amazed at how many clients tell me that their case should be dismissed because they were not read their rights-- I then ask them if they said anything incriminating, and if not, then it does not matter. And if Miranda is violated or Rights were not properly given, the result is not always dismissal, just suppression of the statements obtained in violation of Miranda.

Bottom line-- don't EVER make any statements to the police without an attorney present.

I read this on another forum somewhere. I am unsure how. The OP is under a screen name, which a person would have to guess who it is based solely on their description of the offense. Could that really hold water? Who might be the one searching this out? Do they really have that much time to fool around on a computer hoping to find something? I would hope they have more to do than that.

If not, good advice and food for thought. Shame you have to be scared to find help these days because you might say something wrong.

Did anyone ever find a good criminal defense attorney that doesnt have a lame ad on tv?
I want a good lawyer, not a good marketer. I tried talking to a couple of the "big names" and you end up talking to some junior attorney who's never even had a successful case in front of a judge.
