Emphasize the unsigned handbook and the lack of training. Discuss the length of time it took them to decide to fire you (helps weigh against it being misconduct). You may not get current employees to help you out, but you can question their witness about the less severe punishment being given to others.

Excellent advice. Reps to you on this post. There is a company or two here that represents employers. I don't think they are actually lawyers, but they know the law. I think they represent employers in all kinds of tax and personnel matters.

well I went to the appeal and I think everything went well on my behalf and now I'm just waiting to here back. They said I would be notified via mail in two weeks from the appeal. Well it's now 3 weeks and still no word!? WTF?

There are thousands of these going on in this economy so I'm pretty sure it's taking longer than "normal". But you should be able to call and ask them if it has been mailed. They might not be able to give you info on the phone, but they should be able to tell you if it was mailed. Believe it or don't, but things do get lost in the mail all the time. Sometimes, if you win, the checks start coming before the decision gets to you. If it's direct deposit, check your bank account.

Ok Buzz123 here is my other question. I was denied my benefits again! I cannot believe I was because I thought I had enough proof that I was not properly trained or had a signed handbook in my file. They said something along the lines of a "element of wrongfulness" ?? So to me it seems like they denied me be I should have known better more or less. I don't understand and I am appealing that decision also. But here is the kicker, I received a letter in the mail saying that I owe back all my back unemployment even though when I first received it through another employer from July - Sept. I was seeking employment just like you should during that time and then found the job that I only worked for one month until I broke a policy that I didn't know was a policy due to lack of training. So now they are saying because I got denied from my last employer I owe $3,500.00 that I had gotten from my pervious employer. I dont understand how I had the money given to me buy doing all the correct steps and then just because I got another job and I broke a rule that now they want it all back!!!! I don't undertstand how they can take back money that you were given. It's like if I didn't get that job and I was collecting unemployment it would of been better then trying to get a job. What a JOKE!!!
I know That as of right now I don't need to send money back right now due to the fact that I'm appealing the appeal but what if I don't win again? Should I get a lawyer? I need some help because calling the unemployment people on the phone are not helpful or kind either.
