my employer (I work as a security guard) turned me in for refusing some
shifts and now am getting ready for appeal, have worked for this co. for 4 yrs., lot of times driving 25-30 mi. each way, after I have to pay for gas, at $7.54 hr. that does'nt leave much to live on. When I applied for the job I put I would travel 5 miles each way to work. Am I wrong in refusing jobs further away or can they say my unemployment should be denied (no matter the distance) Thanks for any thoughts

If you have a written agreement with the employer where they agree on the five mile limit ....MAYBE. And that's a big maybe. Probably not though, since those on UI in the Las Vegas Valley are pretty much expected to take suitable work anywhere in the Valley. Even if you had it in writing from the employer, your boss doesn't make state law, the legislature does. So, if such an agreement even existed while you were collecting UI, it should have been an issue for adjudication. Otherwise I believe the law passed in 2009 concerning fraud would apply.

Work is work, and if you read your handbook I think it will answer your question about refusal of suitable work. But, if I remember right, the penalty for work refusal is one of the milder ones. I've seen it come up several times but it's been a long time, and wasn't an everyday thing when I worked for ESD.
