Hmmm perhaps. I am no Lawyer so I won't try to distinguish the difference. That was the prosecutions job. They flubbed it.
Based on what the Youths had to say as well as witnesses they only intended to put a beat down on him and went to far. All the same prison is what they deserved.
My entire argument on this thread is the idea that Luis was an honest hard working immigrant that was singled out for murder. The fact is he lived a life style that would lead to a beat down from someone eventually.
Thats what happens when you tag 15 yearold girls while cheating on your wife.
No I don't believe he should have been harmed but the reality is when you behave the way Luis did bad things happen.
