For the last few months my HOA has been sending me letters about a minor dent on the garage door, which is really small and if you look close enough, most garage doors have a minor dent or nick. They send me 4 letters at once for the same issue - two direct mail, 2 certified mail. It's become really annoying. This week they sent 4 letters (again) to remove weed from my lawn - the thing is there is no weed in my lawn.

When I call the HOA, it always goes to voicemail and they do not call back. How can I stop this harassment?

Try sending them back 8 letters for every four they send to you.

How close is your garage to the street that they can see this "little" dent.

Thanking my lucky stars every day I don't live in an MPC and just a subdivision with deed restricitions.

It sounds like they are serving you notice. Typically, an HOA will need to send 2 notices of the same violation before they can hold a hearing or issue a fine. Often each notice will be sent certified mail and a copy sent 1st class (regular mail). The reasoning is that while delivery of certified mail can be verified some people will simply refuse to accept a certified letter, then try to claim they were never given notice. It's a silly game but a common one. So, most mgt. companies will send a copy of the letter 1st class also. Doing all this makes it very difficult for someone to try to claim they didn't know there was a violation.

If you feel the violation is not fair. You may wish to photograph your dented garage door and the dented garage doors of your neighbors. You could do the same things with the weeds. However you will want to speak to those neighbors to be sure they have not received any notices. If they have received violation notices- it would only serve to show the HOA was acting fairly.
