The contractor is telling you a naked lie to get out of fixing the slab. Make him fix to level or else.

The pour site was not prepared right before the concrete was poured.

I don't know much about construction....but this does not sound good.

Myself personally, this is one of the reasons I would be very, very wary to sign a contract to have a house built. People who sell stuff....that is what they want to do, make money off the sale.........and many times they will say just about anything to make that sale.

It sounds like the ground was not properly prepared before the slab was poured. HUM, I wonder what other defects are waiting to appear in the next couple of years????????

No. Leveling out the concrete is only a temporary repair. You need to find and address the problem, not just the symptoms. You need to make him address the problem causing the settling, not just fix it level. If he plans to merely mud jack it, get help, that is likely a temporary repair and you will have problems in 5-10 years, maybe less. You are talking about big big lose your house type problems that may not be covered under your insurance and leave you paying off a huge mortgage with no house. This is worth spending the moeny to make certain it gets done right.
