If after the death penalty is executed and evidence comes out that the prison was not guilty (rare but it has happened) would it then have become a sin or just a miscarriage of justice? Curious about your view rather than judging about it.

Bible tells us not to judge, as no one has measure. Which is absolutely correct. But society, priests and politicians "knows better". And as we are nothing but a product of those three, we gladly tout to their tunes, embedded into us from day one of our life.

However, applying God's penalty would require having applied God's rules of evidence and judgment as well. Otherwise, the penalty is murder.
