Well, the upper floors are reserved for the penthouses, which are outrageously expensive (starting at $40,000,000). I think its safe to say that there wont be an observation deck.

I think Garrett Kelleher is on record in several places as saying the majority of space in the building above the lobby will be for the exclusive use of its very well-heeled residents... Chicago Spire Information

Never say never, but somehow I think somebody who plunks down MILLIONS is going to go to court if there are any changes to what is above their unit...

The Spire will be 100% condos and the upper floors will be amenities for the residents (as well as penthouses). Without question no observation deck; the building will not be open to the public. If you're curious, the 3 level ameneties layout is on the link below;
Amenities - The Chicago Spire.

I guess those assessments better be going for something at those prices. Residents will def. get their money's worth:

Theatre
Boardrooms
Screening Rooms
Dining Areas
Coffee Shop
Bar
Juice Bar
Cigar Room
Library
Billiards Room
Retail
daycare
Teens Area
Golf Simulator
Spinning Room
Weights
Pilates Room
Yoga Room
Massage Room
Rock Wall
Basketball Court
Sauna
Spa
Lap Pool
Childrens Pool
Whilrpool

Pretty much unheard of..

You know this question could have been added to one of the threads on the Spire that already exist?

Default Will the Chicago Spire be taller than the Sears Tower?

Is it going to be taller than the sears tower? And will it be taller than that Building thats going up in NY to replace the Twin towers? When Will it be completed. Whats the process of it?

It will be taller than the Sears Tower. And it would be taller than the Freedom Tower in New York if the Freedom Tower were indeed built to the 1776 feet originally proposed. However, there is talk that the Freedom Tower design may be revised to make it taller. So we won't know until the final design goes into construction.

The Chicago Spire is to be exactly 2000 feet high, compared to the Sears Tower which is 1451. (Thats almost a 600 foot difference!) It will be 150 stories, compared to the Sears which is 110. At the time of it's completion, it will be the second tallest building in the world, only next to the Burj Dubai, in the UAE, which is a whole 684 feet taller than the Spire.

Right now, they are only on the underground process, they haven't even started on the lobby yet. It is expected to be completed in 2012
