If anyone has not been following the destruction of marketable property titles in all of Lava Zone 1&2 see Punaweb at

Punatalk - Lava & insurance testimony needed

Shortly all properties in LZ 1&2 will be legally defined as unmarketable.

Yes you can still sell property with unmarketable title. However, finding buyers will be difficult.

Here are the proposed zones. (Updated Feb 2015)
==New lava zone designation 11, 12 & 13==
Background:
The USGS doesn't classify volcanoes as active,
dormant, or extinct. Instead it uses activity alert levels.
Property is defined as the combination of land with any
structures and Title.
Title is a legal construct that establishes ownership and
rights to use property.
The Title to a property is defined as unmarketable by
case law within the Courts.
Unmarketable Title is defined based on whether a new,
and otherwise, qualified buyer is denied either financing
or insurance
Red-lining is the denial of service to any area despite
the fact the decision to extend services to an individual
property appears to be safe and sound for the
foreseeable future.
Foreseeable future is a defined period that depends on
agency Fannie Mae considers it to be 36 months.
The reasons for reclassifying the "Lava Zones".
1. The USGS "9 Lava Zones" did not incorporate
volcanic-alert levels.
2. The 9 Lava Zone designations were not intended for,
nor formally adopted, by the real estate market.
3. A typical property buyers is primarily concerned with
the marketability of Title.
4. Many in Hawaii, believe actions by lenders, insurers,
and the State of Hawaii to be violations of Federal laws
prohibiting the red-lining of neighborhoods.
Therefore, just 3 types of property are of interest.
These are:
*Lava Zone 11, areas where Titles to property are
marketable and a new qualified buyer can secure
financing and insurance from firms doing business in
Hawaii.
*Lava Zone 12, areas where Titles to properties are
unmarketable despite the fact they appear to be safe
for the foreseeable future and Federal laws prohibit
red-lining neighborhoods. Further, 36 months shall
define the duration of the foreseeable future in
accordance with Federal underwriting guidelines.
*Lava Zone 13, areas where Titles to properties are
unmarketable owing to an examination of current
volcanic activity by qualified volcanologists working for
the USGS that deemed the property at risk within the
foreseeable future. Further, 36 months shall define the
duration of the foreseeable future in accordance with
Federal underwriting guidelines.
The real estate community was asked to confirm the
new 3 zone system and update disclosure
recommendations in July 2011.
USGS historic designations cannot be used to describe
properties at risk in the foreseeable future. Following
the current 9 zone default system causes both sellers
and real estate agents to commit a violation of law by
failing to adequately disclose a current property
condition.
Note: Since introduced 4 years ago, the Boards of Real
Estate in Hilo and Kona have not voted on their
acceptance. They also didn't adopt the 9 zone system
either. It has been left up to individual sellers how to
describe their properties and 99.99% fail to understand
they are shooting themselves in the foot when using an
unrecognized system.

I thought the 9 zone system was pretty easy to understand by everyone. Of course the agents and sellers were not using the system for lava 3 and under but they were always posting the zone on 5 or up...duh! This new system may be easier for buyers to know if they can get financing but i believe the 9 zone one does a better job at exposing the longer term risk of owning the property. I think some of the Puna propetie values will take a big hit on this.

Good to see it has stalled again.
I just can't imagine what it's like to be on edge like this for 7 months.

June 27th Lava Flow Observations: During yesterday's overflight, HVO staff observed that the inactive flow tip remains stalled with scattered breakouts active about 0.45 to 2.7 km (0.3-1.7 mi) up slope of the stalled flow tip. The lobe extending to the north, about 1.6 km (1 mi) up slope from Hwy 130, hosts the most vigorous activity, and has advanced 300 m since February 19. While the flow continues to widen, no advancement has been observed over the past 2 days. The lobe on the south side of the flow, about 870 m (0.5 mi) up slope of Malama Market, is no longer advancing, but hosts a few active breakouts several hundred meters upslope of the stalled front. Activity continues on the new breakout that started from the upper June 27th tube on the north flank of Puʻu ʻŌʻō. The breakout about 3 km (2 miles) northeast of Puʻu ʻŌʻō at the forest boundary remains active. Scattered activity also continues west of Kaohe Homesteads in the same general areas that have been active for about the last month, as well as in a slightly down slope area. Observers on a Civil Defense overflight this morning reported no change in any of the down slope flow areas.
