Talk to your neighbor first. Be honest, mention your issues, and would they be open to conveying you a piece of property for fair value (Have his house appraised then subtract an appraisal that accounts for the reduced lot size, plus say 10%)

If he agrees....then get a real estate lawyers and get ready for the next hurdles;
1-Deed and HOA regulations pertaining to redividing a lot
2-Local zoning issues pertaining to redividing the lot. There are USUALLY avenues to make a non-conforming lot as long as it is added to another conforming lot.
3-You will need to get it surveyed....a professional surveyor will know the subdivision bylaws for your area
4-Hopefully you can process a boundary line adjustment (not an agreement...that is different), but it depends on your state laws and county ordinances

The first thing though...talk to your neighbor. They control the hand so to speak. If they agree and everything is handled by professionals (I suggest not going lowest price on anything) who provide you value then it should all go nicely. It is usually when people try cutting corners, go low price on everything, that problems like Austin-Steve refer to happen (and they do).
