Complaint inspection conducted in conjunction with this routine inspection
  • Equipment - Food Contact Surfaces, Nonfood Contact Surfaces, and Utensils (corrected on site)
    Observation: Observed accumulations of beverage residue or other debris on the following nonfood-food contact surfaces: back-splash of the soda dispensing machine near drive-thru window.
    Correction: Maintain nonfood-contact surfaces of equipment clean.
  • Physical Facilities in Good Repair
    Observation: Observed rusting on WIR door and on the floor near WIR underneath equipment tanks.
    Correction: Maintain physical facilities in good repair. Poor repair and maintenance compromises the functionality of the physical facilities.
  • Physical Facilities - Cleaning Frequency and Restrictions
    Observation: Observed several walls of the kitchen with splash-staining from food product, dust build-up on ceiling tiles between WIR area and Fryer area and also throughout kitchen, and debris observed on floor of WIR.
    Correction: All floors, walls, and ceilings must be cleaned as often as necessary to keep them clean. Cleaning of the physical facilities is an important measure in ensuring the protection and sanitary preparation of food. A regular cleaning schedule should be established and followed to maintain the facility in a clean and sanitary manner.
03/17/2015Complaint
10/24/2014: Conducted a site visit investigation in response to the above complaint. The following are the findings of this investigation: (1) The PIC/CFM was aware of the complaint. (2) The PIC/CFM stated that the incident did happen. One of the team members asked another team member for some medicine. The team member was given some headache medicine. The team member put the headache medicine in a small plastic single service cup and did not store it in a separate area. The shifts changed. The new team was filling orders and picked up the plastic single use article without noticing the headache medicine in the cup and filled the cup with sour cream. This cup was issued to the customer. The PIC/CFM stated that the customer's parent contacted her and explained what they found. The PIC/CFM stated that upon interviewing the parent, the child was approximately 18 y.o. The PIC/CFM provided the customer with the Corp. information for follow-up. The PIC/CFM then proceeded to train the staff and managers in the proper storage of personal medicine in the facility.The PIC/CFM stated that Corp. also became involved with the facility's training of this issue. During this site visit, no personal items were noted on or near the prep lines. This inspector was shown the new location designated for all personal items( food/personal medicines,etc.).

    Observation: The person in charge failed to state the required temperatures and holding times for the following conditions of potentially hazardous food: (1) Refrigerated storage, (2) Hot holding, (3) Cooling, and (4) Reheating.
    Correction: Ensure the designated person in charge (PIC) is knowledgeable about foodborne disease prevention, Hazardous Analysis Critical Control Point principles and Regulation requirements. The PIC should be prepared to recognize conditions that may contribute to foodborne illness. The PIC must also recognize conditions that fail to comply with Regulation requirements and be authorized to take the appropriate preventive and corrective actions to ensure that the Regulations' objectives are fulfilled.
  • Food Storage Containers - Identified with Common Name of Food (corrected on site)
    Observation: Unlabeled food containers of dried noodles observed.
    Correction: Label working containers with the common name of its contents. Consumers may be allergic to certain foods or ingredients. The mistaken use of an ingredient when the consumer has requested that it not be used may result in severe medical consequences. Liquid foods and granular foods may resemble cleaning compounds. The mistaken use of food from an unlabeled container could result in chemical poisoning.
  • Critical: Food - Potentially Hazardous Food - Cold Holding* (corrected on site)
    Observation: Cut tomatoes, cheese, and sour cream under make unit cold holding at improper temperatures
    Correction: Relocate food to a refrigeration unit that is capable of maintaining food storage at 41°F or below.
  • Temperature Measuring Devices
    Observation: There was no temperature measuring device located in the make unit on center line.
    Correction: Provide a temperature measuring device in all hot or cold holding equipment used to store potentially hazardous foods so that employees can routinely monitor the ambient air temperature.
  • Refuse - Covering Receptacles (corrected on site)
    Observation: Dumpster or outside refuse container was open or uncovered.
    Correction: Cover all waste containers when not in continuous use.

    Observation: Food containers were found stacked while wet after cleaning and chemical sanitization.
    Correction: Items must be allowed to drain and air-dry before being stacked or stored to allow evaporation of chemical sanitizer and moisture that may encourage microbial growth.

    Observation: In-use utensils improperly stored between use
    Correction: dispensing utensil for beans laying in the beans, knife stored between the wall and dish racks.
  • Mops - Drying Mops (repeated violation)
    Observation: Mops not hung up to air dry.
    Correction: Wet use maintenance items such as mops must be hung in a position that allows them to air dry so they are not allowed to grow contamination which can then be spread through the establishment at the next use.
