A complaint was received stating that a customer got sick and experienced nausea and pain in stomach after eating crab cakes and after improper handling of food and drink by the waitress. As per the customer the crab cakes were mushy and did not taste right. Also the waitress handed the drink with her hands covering the rim of the glass and straws did not have paper on the tips.
During the inspection the PIC was aware of the complaint. Crab cakes were held, prepped and cooked (167 degrees F) adequately and in proper way. The straws did not have the paper wrapping around it. Operator reminded to review with the employees the use of proper barrier when handling of ready to eat food and utensils and bare hand contacts. As per the PIC, the facility will be using straws that are prewrapped.
No other complaints were received. The incident is an isolated incident. Hence, the complaint is inconclusive and not found.

    Observation: Several fruitflies observed in kitchen and in bar area in the establishment
    Correction: Eliminate harborage condition and continue pest control treatment to reduce the number of pest in said location.

Complaint#769478
Complaint was received on 3/12/15 stating that the customer had fruit flies in their food.
Complaint inspection was conducted on 3/13/15. The manager on duty was unaware of the complaint. During the inspection several areas including bar, near ice machine, area near soda dispenser and areas next to mop sink observed with live fruit flies. Several areas in kitchen observed with standing water. During the inspection contamination or adulteration of food with fruit flies was not observed. Operator instructed to keep the kitchen/facility without standing water to avoid harborage conditions for fruit flies and any pest.Operator instructed to check the deliveries for any fruit flies, sanitize the areas where fruit flies are commonly seen.
Operator provided pest service report from 2/24/15. Operator informed that they have been working to eliminate fruit fly issue in the facility and will be taking additional measures.

Case ID # 37476
Complaint was received on 11/10/14 stating a roach ran across the complainant table which backed to the kitchen and then climbed into a notch in the wall while they were eating at the restaurant. The complainant was concerned that there may be an infestation and wouldn't want anyone to get sick. Said incident had occurred on 11/8/14.
Person in charge was aware of said complain. The person in charge pointed that it had been an ongoing issue and they were working to address said issue. PIC provided the last two inspection reports from 10/22/14 and 11/04/14. PIC also mentioned that they are in 2 weeks inspection/treatment cycle with pest control company.
During the inspection, two live roaches were observed in the facility. One under the hand washing sink in kitchen and one on shelf in dry food storage area. Continue working on pest control. Eliminate any harborage conditions such as broken tiles, holes in the wall, close the entrance from outside by eliminating the gap between the door and the floor. Follow up inspection scheduled on 11/19/14.

    Observation: Open containers of shredded coconut and open bags of seasoning observed on shelves in dry food storage room where live roach was observed.
    Correction: Protect food from cross contamination by storing food in packages, covered containers, or wrappings.
  • Physical Facilities in Good Repair
    Observation: Broken tiles and holes in walls not maintained in good repair in kitchen/food prep area/storage area. Gap between the door and the floor observed in door leading to garbage area. Such conditions are conducive to pest harborage.
    Correction: Maintain physical facilities in good repair. Poor repair and maintenance compromises the functionality of the physical facilities.
  • Critical: Animals - Prohibiting Animals*
    Observation: Two live roaches (one under handwashing sink - ran into floor drain in kitchen and one on wooden shelf in dry food storage area) were noted in the establishment.
    Correction: Prohibit all live animals on the premises of the food establishment. Animals carry disease-causing organisms and can transmit pathogens to humans through direct and/or indirect contamination of food and food-contact surfaces. Animals shed hair continuously and may deposit liquid or fecal waste, creating the need for vigilance and more frequent and rigorous cleaning effort.

    Observation: The food-contact surfaces of the plates and utensils were not observed sanitized: the high temperature dishwasher did not reach the required temperature as per the manufacturers specification to sanitize.
    Correction: After cleaning and rinsing of the food-contact surface, the surface shall be effectively sanitized before coming in contact with food and before use. Operator voluntarily set up the three compartment sink temporarily until the dishwasher is repaired.

As per PIC-hot water heater for handsinks in toilet rooms was replaced.
Toilet room handsinks=measured 112, 113 initially but hot water immediately fell to 76-60F range.
Employee toilet room faucet has been repaired, dipper well repaired and final rinse on dishwasher is adjusted.
Facility contacted plumber for site visit tonight and will email health department with updates throughout weekend.
