    Observation: Food employees are not informed of their responsibility to report to their PIC information concerning their health and activities as they relate to diseases transmitted through food.
    Correction: PIC is to advise employees of their responsibility to report in accordance with law information concerning their health and activities as they relate to diseases transmitted through food.
  • Critical: Cooling* (corrected on site) (repeated violation)
    Observation: Sushi rice noted not being adequately cooled to prevent the growth of harmful bacteria (voluntarily discarded).
    Correction: Cool potentially hazardous foods from 135°F to 70°F within 2 hours and within a total of 6 hours from 135°F to 41°F. A longer time for cooling allows an ideal situation for bacterial growth. This has been shown to be the major contributing factor in many foodborne illnesses.

Discussed the use of Time as a Public Health Control for the sushi rice and General Tso's and sweet and sour chicken. Discussed handwashing, employee health, cooling methods, date labeling with person in charge. Will work on a risk control plan with operator. Also discussed how and when to clean and sanitize the meat slicer. Went over the need to have a knowledgeable person in charge and strongly recommend manager's certification. Operator provided Parasite Destruction letter from supplier.

    Observation: The person in charge failed to state the required temperatures and holding times for the following conditions of potentially hazardous food: (1) Refrigerated storage, (2) Hot holding, (3) Cooling, and (4) Reheating. Went over temperature parameters with operator. Strongly recommend manager certification training.
    Correction: Ensure the designated person in charge (PIC) is knowledgeable about foodborne disease prevention, Hazardous Analysis Critical Control Point principles and Regulation requirements. The PIC should be prepared to recognize conditions that may contribute to foodborne illness. The PIC must also recognize conditions that fail to comply with Regulation requirements and be authorized to take the appropriate preventive and corrective actions to ensure that the Regulations' objectives are fulfilled.

Gave operator an employee health policy to post and go over with employees.

  • Critical: Hands and Arms Cleaning Procedure* (corrected on site)
    Observation: Improper handwashing procedures observed. Observed an employee washing hands without soap and then drying their hands on their apron. Explained to the employee how to properly wash and dry hands.
    Correction: Ensure all food employees clean their hands and exposed portions of their arms with a cleaning compound in a lavatory by vigorously rubbing together the surfaces of their lathered hands and warms for at least 20 seconds and thoroughly rinsing with clean water.

    Observation: Observed that food in the reach-in prep cooler and walk-in cooler was not protected from cross contamination because it was not in packages, covered containers, or wrapped.
    Correction: Prevent cross contamination by storing food in packages, covered containers, or wrappings.

    Observation: Unlabeled food containers of salt, msg, and sugar.
    Correction: Label working containers with the common name of its contents. Consumers may be allergic to certain foods or ingredients. The mistaken use of an ingredient when the consumer has requested that it not be used may result in severe medical consequences. Liquid foods and granular foods may resemble cleaning compounds. The mistaken use of food from an unlabeled container could result in chemical poisoning.

    Observation: Food in contact with equipment or utensils that have not been cleaned or sanitized as required. Observed food employee handling bowl that had raw meats in it and then handle raw brocoli to put in carry out container.
    Correction: Use only cleaned and sanitized utensils or equipment during food preparation. Discussed with operator the flow of raw and ready-to-eat foods in the cook line and how to separate tasks by the use tongs and gloves when handling ready-to-eat foods.

    Correction: Store in-use utensils or dispensing utensils in one of the following manners: 1) In the food with their handles above the top of the food and the container. 2) In food that is not potentially hazardous with their handles above the top of the food within containers or equipment that can be closed. 3) On a clean portion of the food preparation table or cooking equipment only if the in-use utensil and the food-contact surface of the food preparation table or cooking equipment are cleaned and sanitized every 4 hours. 4) In running water of sufficient velocity to flush particulates to the drain. 5) In a clean, protected location if the utensils are used only with a food that is not potentially hazardous. 6) In a container of water if the water is maintained at a temperature of at least 135°F.

    Observation: Fried rice in walk-in cooler made yesterday noted not being adequately cooled to prevent the growth of harmful bacteria. Voluntarily discarded

Stirring the food in a container placed in an ice water bath 5. Using containers that facilitate heat transfer 6. Adding ice as an ingredient 7. Any other method that can effectively accomplish cooling.

    Observation: Chicken broth hot holding at improper temperatures on a wooden shelf near the floor. Rapidly reheated and then put on hot line.
    Correction: Hot hold potentially hazardous food at 135°F or above to inhibit the growth of harmful bacteria.

    Observation: Sushi rice and garlic and oil cold holding at improper temperatures (voluntarily discarded).
    Correction: Discard the food and ensure that potentially hazardous foods for cold holding are maintained at 41°F or below to inhibit the growth of harmful bacteria.
  • Critical: Date Marking - Ready-to-Eat - Potentially Hazardous Food - Date Marking* (corrected on site)
    Observation: The prepared ready-to-eat (RTE) duck, general tso's chicken, cooked shrimp in sushi reach-in cooler, and egg rolls, in the refrigeration unit is not properly dated for disposition.
    Correction: Mark the name and "consume by" date on the container of RTE foods at the time of preparation if the food is to be held for more than 24 hours. If the food is held at 41°F or below the food shall be served or sold within 7 calendar days. Some harmful bacteria continue to grow even at refrigeration temperatures so limiting the amount of time in storage limits the amount of growth allowed for these bacteria.
  • Temperature Measuring Devices - Ambient Air and Water
    Observation: The ambient (air/water) temperature measuring device (degrees F) located in the walk-in cooler is not accurate.
    Correction: Provide a temperature measuring device that is accurate within +/- 3 degrees Fahrenheit in the intended range of use.
  • Equipment - Cutting Surfaces
    Observation: All the cutting boards are heavily scratched and scored. The food contact surface is no longer easily cleaned and sanitized due to condition. Operator will replace.
    Correction: Resurface or discard and replace the cutting boards to provide a food contact surface that is smooth, easily cleaned and sanitized.
  • Critical: Equipment - Food Contact Surfaces, Nonfood Contact Surfaces, and Utensils* (corrected on site)
    Observation: The following utensils were observed soiled to sight and touch: in-use cutting knives werer visibly soiled and being stored under the microwave.
    Correction: Clean and sanitize these surfaces for food contact.

    Observation: Observed accumulations of dust, dirt, food residue or other debris on the following nonfood-food contact surfaces: dry storage container.
    Correction: Maintain nonfood-contact surfaces of equipment clean.
  • Handwashing - Using a Handwashing Lavatory - No Other Purpose (corrected on site)
    Observation: The handwash station at the sushi station is being used for purposes other than washing hands (observed plastic container and plastic bottle in sink). Went over with person in charge the use of the handwash sink.
    Correction: The handwash facility identified above is to be used for washing hands only

    Observation: The caulking by the 3 compartment sink is not maintained in good repair and needs to be replaced.
    Correction: Maintain physical facilities in good repair. Poor repair and maintenance compromises the functionality of the physical facilities.

Discussed the importance of educating employees regarding employee health standards, cross-contamination prevention methods and food temperature controls.
  • Critical: Demonstration of Knowledge* (corrected on site)
    Observation: The person in charge failed to identify Critical Control Points (CCP) in the operation from purchasing through sale or service. The PIC is not aware of the relationship between controlling CCPs and the transmission of foodborne illness.
    Correction: Ensure the designated person in charge (PIC) is knowledgeable about foodborne disease prevention, Hazardous Analysis Critical Control Point principles and Regulation requirements. The PIC should be prepared to recognize conditions that may contribute to foodborne illness. The PIC must also recognize conditions that fail to comply with Regulation requirements and be authorized to take the appropriate preventive and corrective actions to ensure that the Regulations' objectives are fulfilled. Discussed risk factor observations and got corrective actions during inspection. Discussed food safety manager certification training for PIC and owner of the facility.

    Correction: Train employees to always wash hands after touching face / nose etc.. or handling potentially contaminated raw animals or equipment. PIC was made aware of observation and corrective actions were discussed.
  • Critical: Food - Packaged and Unpackaged - Separation, Packaging, and Segregation* (corrected on site) (repeated violation)
    Observation: Raw food of animal origin holding in a manner that may cause cross contamination of to ready-to-eat food (RTE). Pan of raw thawing pork meat observed overtop of a pan of cooked ready-to-eat rice (cooling).
    Correction: Separate raw foods during storage, preparation, holding, and display from raw RTE food including other raw food such as fish for sushi or molluscan shellfish, or other raw RTE food such as vegetables, and cooked RTE food.
  • Food Storage - Clean and Dry Location (corrected on site)
    Observation: Food stored in a location where it is subject to splash, dust or other contamination. Large bag of onions in the dry storage area observed directly on floor.
    Correction: Store food where it is not exposed to splash or install an approved durable, and cleanable barrier between the splash source and the food to prevent contamination.
  • Critical: Parasite Destruction*
    Observation: Raw sushi for service or sale in the ready-to-eat form on display did not have supporting documentation to ensure parasite destruction. An invoice from a large professional company that supplys sushi products throughout this area was provided by the PIC to prove where the product had been purchased from.
    Correction: Assure parasite destruction of raw, raw marinated, partially cooked or marinated-partially cooked fish by freezing to one of the following time/temperature combinations:
    1. Freeze at -4°F (-20°C) for 168 hours (7 days) in a freezer
  • Cooling Methods (corrected on site) (repeated violation)
    Observation: The methods used for cooling were not adequate. Large pans of warm rice were covered with plastics to cool on a cooling rack. Given the volume and density of the product - inefficient cooling could occur.
    Correction: Cool foods by the following methods: 1. Placing food in shallow pans 2. Separating food into smaller thinner portions 3. Using rapid chill cooling equipment 4. Stirring the food in a container placed in an ice water bath 5. Using containers that facilitate heat transfer 6. Adding ice as an ingredient 7. Any other method that can effectively accomplish cooling.
  • Critical: Food-PHF/TCS-Cold Holding-shell eggs (corrected on site)
    Observation: Cooked rice observed at 56 F (approximately 1 hour in temperature danger zone). Rice pan was left out to "warm up" prior to reheating.
    Correction: PIC took requested action by returning the pan to the walk-in cooler (operating at 41 F or less). Discussed not letting foods sit on counters but to take directly from cold holding refrigeration units just prior to reheating.
  • Critical: Time as a Public Health Control* (corrected on site)
    Observation: No written procedures for the use of time as a public health control with potentially hazardous foods. Four hour time tracking was not occurring in the production of sushi rice.
    Correction: Provide written procedures for the use of time as a public health control. Have sushi chef mark the sushi rice holding container with a 4 hour hold time. Once 4 hours is reached, discard sushi rice and make a new batch with another 4 hour hold time. The procedures must include the following steps or practices: a. Food must be marked with the time within which it must be cooked, served or discarded. b. The food is served or discarded within four hours from the time when the food is removed from temperature control c. Food in unmarked containers or packages, or for which the time expires is discarded and d. Written procedures are maintained in the food establishment and made available to the regulatory authority upon request e. Once time is implemented as a control measure for potentially hazardous food, no other measures may be substituted. Discussed with PIC and corrective actions were taken.
  • Critical: Food - Consumption of Raw or Undercooked Animal Foods (corrected on site)
    Observation: A review of the menu with the foodservice operator indicates that sushi may be served raw and/or undercooked.
    Correction: If an animal food such as beef, eggs, fish, lamb, milk, pork, poultry, or shellfish is served or sold raw or undercooked the permit holder shall inform consumers of the significantly increased risk of consuming such foods by way of a disclosure and reminder using brochures, deli case or menu advisories, label statements, table tents, placards, or other effective written means. Menu had a blanket consumery advisory but did not asterisk the specific food items that could be served raw / not cooked. PIC agreed to update menu at next printing.
  • Handwashing - Using a Handwashing Lavatory (corrected on site)
    Observation: The handwashing facility located at the front food preparation / sushi preparation area is blocked, preventing access by employees for easy handwashing.
    Correction: Access to the handwashing facility identified above is to be available during all hours of operation. Remove the cardboard boxes preventing its use.
  • Light Bulbs Protective Shielding
    Observation: Light fixture in the back storage area is not shielded not shielded, coated, or otherwise shatter-resistant.
    Correction: Shield or replace light bulb with a coated or shatter-resistant bulb. PIC agreed to correct.
