I know trials can be a matter of opinion. nickolae miu was convicted of 1ST Degree negligent homicide among other charges. the judge allowed prosecution to add charges near the end of the trial which would prevent the defense from preparing for those added charges. the defense wanted to emphasize burden of proof more for the state. the state has the burden of proof to prove it was not self defense. I don't know if anyone here watched the trial. some say this trial was the most polarizing in a long time. some claim that they had no doubt he was guilty. he was using self defense and was surrounded. I think the judge had it out for him.

Do you like the jury trail system? should jurors have their IQ tested or be trained in how to interpret the judges instructions? perhaps a non biased lawyer could explain the instructions better to the jury.

Some people though with high intelligence seem very biased so I don't know if a intelligence test would solve anything.

This case got me real angry because an innocent man who defended himself is going to die in prison. The young adults who were on the river lied under oath. their accounts of what happened where not the same. they lied about a girl getting punched. there was a video taken of the whole incident. if there was no video this guy would have been doubly screwed because all the people on who where friends with the people stabbed lied. it looks like none of them will be charged with attacking Nick nor will get in trouble for blatant perjury.

The video of the incident is all over the internet. The kids taunted him and accused him of being a pedophile. they pushed him and punched him. They pushed him into the water. one kid died after attacking Nick another kid was disemboweled with his intestines hanging out after he attacked nick. These kids were dumb and drunk and they got what they deserved. One of the kids you can see in the video clearly attack nick lied and said he was trying to keep peace. these kids are scum of the earth. some are wishing more bad things to happen to these young adults that attacked nick and now caused him to spend the rest of his life in prison. they caused their friend to lose his life. no one in the trial nor nick said they were sorry for anything. Nick was defending himself he should not have to be sorry for anything. he had the knife out and the kids still attacked him.

Self defense is dead in America because people are too stupid. if you get attacked you will not be allowed to fight back . this man has a bad heart condition too.

It was not as cut and dry as you are making it out to be.
Granted he likely should not have faced some of those charges, and the teens and adults who bullied him should have also faced charges.

you are one of the rare ones that is split down the middle on this one. they did a poll where like 8 thousand voted and 53 percent said he was not guilty. him lying after is irrelevant if his actions were self defense or not.

those kids committed perjury and I don't think anyone of them will be charged. they attacked him and they get no charges.

Very different story. Dude ran up and started stabbing and then tried to claim self-defense after he was hit in response to stabbing people, lied to the cops and claimed it was the other guys with knifes. Which is true, who knows. If prosecution has the duty to present evidence that their narrative is beyond reasonable doubt accurate. Apparently they did. And yeah, if their narrative is accurate there's no way this was self defense. Yes, he got upset by being called a pedo but that's no excuse to run up and start stabbing people.

I watched the trial and the video. He did not start stabbing people . He held a lot of restraint. They pushed him into the water. They punched him. He held the knife and only stabbed when attacked. I suggest you watch the full videos.

I don't know enough about this incident to form an opinion but my husband watched it closely and agrees with you and not this jury.

The prosecution doesn't get to "add charges". The prosecution can ask for lesser included charges to be considered.

A claim of self defense must be proven by the defendant, not the state.

The jury system is what we have. Are you accusing the jurors of being low IQ?

Miu is guilty. He could have walked away at any time. Now he gets to pay for his crimes.

I didn’t follow the trial, but I’ve tubed this same river many times. He was surrounded and assaulted in the water because he was looking for something he dropped in the river. Where he crossed the line was when he was surrounded and pushed to the ground and punched, that’s not when he started stabbing people. He got up and went away and pulled the knife and came back. Being able to leave takes self defense away….I was on assault self defense jury last summer. The kids should be charged with assault, and he should be charged with stabbing/murder.

Miu is guilty. He could have walked away at any time. Now he gets to pay for his crimes.
The burden of proof is with the state. Ya I am accusing the jurors of being dumb. Even for people with good intelligence the instructions were 29 pages long. How can a lay person follow all those instructions if they don't have a law degree.

He is 100 percent innocent he only stabbed when attacked. He did not randomly stab people. He could not have walked away he was surrounded. Even Bruce Lee could not take on 13 people with his fists so the stabbing was justified. He has a heart condition he could have died.

in Wisconsin there is no duty to retreat. i read the law online. It was a chaotic scene and happened within seconds.this is a case of f around and find out.he had every right to use that river.
