I have lived on the same block for a little over 11 years and NYCHA has already transfered me once, but that was because I put in a transfer to a different NYCHA development (projects). However, if an apartment becomes available in your current development BEFORE a vacancy in the requested development, you have to take the apt in your current development. Fine! So now that I have been here for 11+ years and grown some roots in the 'hood, NYCHA wants to transfer me to a smaller apartment. It's not really fair to just uproot someone that has put so much into their home. I have been told many times that my apt doesn't even look like a 'project' apt. The housing mgrs always bring visiting NYCHA officials to my home when they have to show (show off) them some of the tenants apts. I didn't mind that, even if they never asked me! I don't want to leave my home and I am too sick to even think about packing up and moving...again. I'm alone now and my children don't live in NY, so I don't really have anyone to help me. If I am forced to transfer I will lose almost everything I own. I am sick to my stomach with worrying about this and wonder if there's a way to not make this a reality. Is there anyone here that has any suggestions? Or feel free to pass this on to a friend/family who is well versed in housing law.

I guess my question would be WHY they're forcing you into a smaller apartment? Is it because you no longer have family living with you?

You are living there for free, correct? I would think that alone gives them the right to move you.

The law you probably need to be researching is do they have to help you move b/c you are sick, I would think they would , but if you are not paying to live there, then i would think you have no claim on the apartment.

What is the reason they gave for making you move?

I am sorry this is happening to you. But you must have known that this was a possibility one day. After all is not really 'your' home. But I really can understand your attachement to the place, since you have been there for a long time and try to make it 'your' home. But they own it literally, and as far as I know, I think you must do what they tell you to do. At least you are getting a place in the same building, and I really wish you good luck adjusting to the new place.

yes they can ask you to move if your name is the only one on the lease now and you have a 2 or 3 bedroom. i know people that its happened to.

You also need to remember that there are many family with children in housing even in your current development that are overcrowded. You live a lone now and it seems fair to move you to smaller apartment so that someone who really needs the living space can have access to it. I am waiting for a larger apartment and i have 4 children in a 2 bedroom apartment; however many of the 3 bedrooms are lived in by older people whos children are grown up and living there own life. I look at it as a cyle. I think people should be place according to their need. You really dont need a large apartment now that your children are gone; someone can actually be sleeping in those bedrooms.

same situation happened to my me and my mom dude. ME my bro and my mom currently occupy a four bedroom apartment and one and a half bathroom in a nycha building in the mott haven section of the Bronx. And our building does not look like a housing project and much more safer then a housing prject and much more cleaner. A couple of years back housing management wnated to downsize us nad move move us into a two bedroom unit in a project developement. We were like no. We kept on ingoring thier requests and today we still live in our 4 bedroom apartment and we live pretty cozy and comfortable.

Uh huh. So a family that really NEEDS a four bedroom apartment can't have one.
