It can take many years before a bank or whoever holds note to foreclose on a property in NYS. Eejits know this and simply use legal process to drag things out for long as possible.

Those in Albany and elsewhere will say such instances are outliers and that most homeowners are deserving of second, third, fourth, fifth, sixth... chances to keep their homes.

we won a house in a tax lien sale in jersey….

normally we get 18% interest and eventually they get someone to go in as a partner in the house and pay off the lien.

but in this case the owners let it get auctioned off.

so we won the house but now getting them out was on us.

we had to evict them

so now we are in to this for 2 years back taxes at 12k a year , and now legal fees .

they used every tactic to stall the court so they were finally evicted almost one year later and 3 years taxes

but now they left their stuff behind . it was basically junk but nj law says we have to store it for months and if not claimed and paid for it is ours .

so now a moving company moved everything out to storage . now we had storage fees for 6 months and moving expenses .

at the end of the time frame we had to pay again to have the stuff removed .

while the house was empty , we can't prove it but we are pretty sure the ex owners went back inside and vandalized the house ripping out all plumbing and wiring .

basically the house was trashed . my partner luckily was a builder so we ended up gutting it and starting over inside .

by the time we sold it the money we made and the aggravation was hardly worth it .

i would never get involved with these tax liens ever again .


but it’s not just new york where evictions take years

Sorry to hear your tale of woe.

Tax lien sales are a product of a very messed up system. No reason why private speculators should be involved in tax collection. If an owner fails to pay RE taxes, the government gets a lien automatically and can pursue all sorts of remedies including foreclosure. Lenders can and should be doing a better job making sure that taxes are paid on time. If a lender is involved, it should be their headache, pay the taxes, or lose the right to foreclose on any existing mortgage. The government can then sell the property on the open market, free and clear, to a new owner willing and able to pay taxes. The debt for taxes can be paid from the sale. The government is made whole. No speculators needed.

In the meantime, judges in the landlord tenant court should only allow people to stay while more than a year of back taxes is due, if they make monthly payments toward the tax debt. Otherwise, 30 days and you are out. Yes, sometimes there are hardship cases, illness, etc., that can delay eviction. But these are exceptions.

I heard of people who were in the same predicament. They bought a foreclosed house but degenerate squatters were living there like rats, unwilling to leave. It took them years to get the losers out.
Also had a family member go through something similar with an apartment rental in their 2 family house. They had kids which made it even more difficult to get them out. The worst part was that the dad was a doctor and they had the money to pay but didn't want to.
This is why I'll never, ever consider a foreclosed home and advise people to stay away from them. Especially in New York.
PA is a whole different story. You don't pay your rent and the Marshall will come and throw you out by the end of the month.
