This is no different than grand theft, and as such, employers should be subject to criminal penalties for grand theft, concurrent sentenecing per offense, of course.

Yes, some of the comments are very informative, and I've experienced the salary scam recently. My employers tried to get us all to agree to be salaried when we make nowhere near the required weekly pay of $455, and this would have cut our pay in half. They had cooked up a pitch for this telling us that when hours were short we'd get the same for working 12 hours a week, $200, as when we worked 48 hours a week. It was telling that the scheme would not start until we were working 48 hour weeks, and when the season ended they could do anything they liked and change the agreement as they pleased.

At the cafe they have a tip jar in front of the register. All the tips go into the owners pockets, they get tipped for our hard work.

I'm giving notice there today having found other work.

That is especially illegal. You should report them. Tips cannot be confiscated by the owners in a restaurant.

Yeah, I know, this couple who owns the place are quite crooked, and I just want out of there. We have no idea how much is in that tip jar each day, we just know they keep it. I asked the manager once about it, and he just said, "Oh, there's not enough in there to worry about."

I have to work two jobs for the next two weeks, I'm giving notice today when I go in. I want to leave on the best terms I can even though they have cheated us, bullied us, and tried to illegally cut our pay. I at least want to preserve the job reference, for whatever good that might do me.

After leaving, report them to both your local DOL and the IRS/state department of revenue. It is both wage theft, and tax theft, as those tips are taxable, and no doubt, not reported by the thieves you work for.
