I work retail. I am the only full time assistant manager. I am willing to work whatever days/nights EXCEPT for Sunday nights. I have been where I'm at for years and whatever manager I had at the time always found a way to make it work between themselves/other assistants/etc. I recently got a new manager. Another assistant that's been there 3 months that never works weekends was asked to help cover Sundays, he refused. We are getting another assistant transferred from another store who has NO night availability at all, big help there. So far as I know, neither of them are having their feet held to the fire to have greater availability, but I feel I am. I am full-time, but I have seniority and have always been consistent that I'm not available sunday nights. So long as these other 2 assistants with their limitations are retained, I couldn't possibly be terminated for not being available for ONE specific night after YEARS of service could I? Already looking for another job cause of this nonsense.

That's a tough condition to have for working retail. I would look for a new job outside of retail if I were you.

Employers can pretty much do anything they want to you these days and it's considered acceptable by a surprising portion of Americans. $$$ talks.

Of course you can be fired for that. You can be fired for pretty much anything that isn't classified as discrimination against a protected class (and even then they will just say it is something else).

Have they actually said to you they will fire you if you don't work Sundays?

Back to the original question, yes you can be fired. However it sounds as if the DM is truly not making a smart move with the staffing situation. I would never put three people at that level with limited availability. Start putting feelers out for new jobs" Good luck!

Yes, you can be fired for refusing to work your scheduled hours. I don't think that's wrong. It is what it is.

If your schedule has changed to the point where you can't work it, you need to find another job.

The truth .........you can basically be fired for anything as long as it's not sex harassment, racial, ethnic to my understanding.

Well retail generally isn't 9-5 M-F. The store manager at my shop sometimes works overnights to check up on things.
