How could they collect? UI claims are posted against an employers record, and affect their unemployment rate. OP has no earnings at new corp, so it cannot be based on that. It would be unfair to penalize his ex employer who did not lay him off.
It's one of those terrible things which can only be attributed to negative fate.
This may not exactly be true. When I was displaced from a company, I did not have enough quarters put in in the state I was in. The state suggested I go after UI against another state where the prior employer was since I had 9 years of employment in that state. I was able to draw UI from there. It certainly is worth a try. This situation sucks...an offer was withdrawn for me and another candidate one time, but at least, I was already unemployed and didn't have to suffer the same situation you were in. Best of luck!
Hello,
I had a job offer while still employed, that I interviewed for and was offered. I accepted, went through the back round check and drug tests. I was to start April 16th. I gave my current employer a 2 week notice and all was good. On friday the 13th, I was notified by my new employer that the customer has decided not to fund my position so the offer is rescinded. I am reallly in a pickle here. They offered a one month severence but that does not sound fair...any thoughts or am I just out of luck?
also, my previous position has been filled.
Perfectly legal.
It's called At-will employment.
Now if you're asking if what they did was morally right, hell no.
