Recently they posted by the time clock an announcement for hiring an H-1 visa for 3 years at a salary of $44,990 as a Lodginig Manager. This salary is over $8k more than I make as a US citizen, veteran Assistant Controller of a high end hotel. Additionally this title is not accurate as the position does not manage or direct anything close to the actual position. Isn' the pay variance illegal? If so what is best way to approach? Thanks
Do you collect health care benefits as a permanent employee that the term contract would not include? They're worth a couple thousand. Does the position require bi-lingual as a skill? How about your position? Usually language skills in hotel/service fields are worth a few thousand.

3. So far as I know, this wouldn't be illegal. Companies can pay whatever they want. Unless you are in a union shop, of course.
Are you getting a 401k match? That can add up. Also I'm not sure the legal ramifications of social security and medicare payments. A visa holder is supposed to be temporary so if they pay in that is money they won't get back.

H1B can be given to any foreigners and there's no requirement of "no qualified American is available". However, H1B holder must be paid in what is called "prevalent wage" meaning the employer cannot purposely pay H1Bs lower salary than any American. In majority of the case, the foreigners are willing to do the work for lower pay.
In your case, I don't know the details so I can't say it's fair or not. My advice is that if you don't think it's fair, go somewhere else. :-) There isn't any point arguing who gets paid what and how much. If you don't think they treat you fairly, walk away. :-)
