Oh no it happens lol. Robbers are idiots they break into houses with families in them unknowingly. Generally yes most at least have enough intelligence to stalk you to know if you are not home, but others not so much or they make a mistake judging if your home or not.

Again I agree, it will be hard to know unless you are in the situation. Knowing me I would never kill a human being who is not threatening my life or others. I can't do it. Also most burglars are probably going to run when challenged except save for the more armed crazy ones.

I think it all comes down to reasonable force..

eg using necessary force to prevent the a burgler from harming you.. if they are armed and you can grab a knife or something to hit them over the head with then fine, but if someone intrudes and you stab them 30 times.. then that is obviously way OTT and you should be charged with murder

Doesn't Britain have pretty much the same laws of using necessary force as Finland does? You can't blast the brains out of some burglar, but if someone tries to kill you with a kitchen knife you can punch his teeth on the pavement if it's necessary?

In NZ, legal cases involving the use of force in the house, have established that no one can presume to know the intentions of an intruder, therefore any use of force is justified.

Complications for the occupier arise if there is a question of action still been taken after the intruder has been incapacitated

The law in the UK is that you can use reasonable force to protect yourself, and you do not have to be attacked first in order to use reasonable force. Reasonable force can include the use of a weapon, because the way the law works in the UK is that in such a situation most people wouldn't be expected to make fine judgement in the heat of the moment. Even if the intruder dies, most likely you won't face prosecution. You can also do a 'citizen's arrest' by chasing them down the street and knocking them out, if necessary.

Like in New Zealand, if the intruder is incapacitated and you continue to harm them, or worse, then you will more than likely be prosecuted because it will then be considered excessive.

In the case of an intruder dying, I think it mostly relies on intent. If you intended to kill them, it would be seen as worse, but if you say hit them in the head with an iron bar and they died from their injuries, you probably wouldn't face prosecution because the intent to kill wasn't there. If the intruder tried to kill you and you killed them instead, it's unlikely anything would happen to you.
