After one gets CA SDI for one year with the Max limitation, is the one allowed to claim a NEW, the 2nd CA SDI if she/he is still under disability and the 2nd claim has enough income in its base period ?

For example,

Work until April 30, 2018

1st CA SDI: start in May 2018 to April 2019 ( base period: Jan 2017- Dec.2017)
2nd CA SDI: start in June 2019 ( base period Jan 2018 -Dec 2018)

Thanks!

I'm unaware of a 2nd year claim for SDI (unless it's a new injury/disability claim altogether and you have the base period earnings which you would have Jan-April 2018 if you had a new injury/disability next June).

It's my understanding a claim is valid for up to 52 weeks (unless you receive other monies or work part-time during your benefit year in which case it will continue past 52 weeks until your balance runs out). If the 52 weeks runs out and you're still disabled, you can look into federal disability benefits. But, I've heard the standard of "disability" is much higher and takes a long time to get approved (no personal experience). In fact, if you and your doctor anticipate your disability will last longer than 52 weeks, you might like to get the application going sooner than later and not wait till next year.

Or, if you anticipate you may recover and be ready to work by or before then, but don't have a job to go back to, you could file for UI--just be careful not to let your UI base period wages age away.

Milezsmilez,

Thank you very much for your response.

I have another question: if I get the SSDI approved while I am still under CA SDI coverage, can I receive both benefits together?

Thanks again

I believe, but don't know, that receiving SSDI will reduce it since they are similar benefits, but, call them and ask. You can also check the FAQs on the SDI site, I believe your question may be addressed there.

It is sometimes a very long wait (longer than UI!) when you call CA SDI, but once you get someone, they are very helpful.
