Living in Illinois and I had been on the job 6 months when I suddenly got sick. Ended in the hospital and told the General manager I needed to quit as I didn't know what was wrong with me and doctors wanted me to take lots of test and see different specialist before I would know what was wrong with me. General manager told me to take care of my health and as long as I kept her updated with what was going on she would hold a position for me. She even told me to keep my key to the store and all other manager merchandise that is normally returned.
I did as she asked and kept her updated weekly for about 6 weeks when I told her I was clear to return. She told me that because I wasn't there to complete a training that she had to take me out of the system. But that I was eligible for rehire with the company.
My questions is am I eligible for unemployment? It sucks because everything with us was verbal but I do have call records and text messages where we communicated during the time that I was off where we discussed how she couldn't wait until I came back and how the store was without me. Even talking weekly for 6 weeks she never brought up any training that I needed to complete or anything. I could've went in to do the training or did it from home as it was all computer based and I wasn't on any kind of official leave that prevented me from doing any work.
I did apply and I had a phone interview they told me that the compnay had 10 days to respond and I would receive something in the mail with a discussion.
Sorry for the rambling just wanted to give as much info as possible.
I did try to resign from my position because I didn't want them depending on me to return and I wouldn't know when I would be coming back as I wasn't covered under fmla I couldn't take a leave. But she did not except me resigning she told me that she would hold my position as long as I kept her up to date and I did communicate with her weekly sometimes 2-3x a week as she would contact me as well. None of those times did she tell me that I needed to do a training or that anything would effect me returning.
You just don't understand what you were supposed to do to get UI, and your story is wrong.
When you are too sick to keep doing your job:
You have to ask for a leave of absence.
Then when you are cleared to work, you ask for your job back.
Only after you are told, "no job available" do you get UI.
You didn't say anything about asking for a leave of absence. Instead, you say you told the boss that you wanted to quit. A deputy making the decision would be within their rights to deny you for that reason. However, in spite of you not asking, the employer let you have a leave which might intervene. By all rights, if IL allows a medical quit, you should get benefits, but the way you told your story is subject to misinterpretation.
However, next time you want to try to get UI, get help BEFORE you do something that you can't undo. The best time to start is BEFORE you lose your job, BEFORE you walk out the door, BEFORE you fill out your UI application, BEFORE you fill out an questionnaire or have a phone interview, etc. Too many do things after there is a problem, and sometimes the damage is done and can't be fixed.
My ultimate goal wasn't to attain unemployment benefits it was to take care of my health. There was no before to think or plan out. One minute I was perfectly fine the next minute I was waking up in the hospital.
Then you shouldn't be disappointed if you don't get it.
