I do agree with Chyvan that if you're willing to put up with TX (and its lower benefit) - and prefer to hedge your bets for a worst-case scenario and reserve the NJ earnings - ultimately you should prevail in TX. Whether or not they accept the quit, TX does need to recognize the subsequent earnings, so - hopefully - would just grant the claim. Unless your employer accuses you of all manner of misconduct which will take time to fight. It would be wise to assume the worst on this and a possible uphill battle before TX finally pays.
Therefore, I cut to the bottom line yesterday on this thread - for two reasons:
- the differential in overall $$ - over 26 weeks there is a $4,732 differential in benefits received - $454/wk TX v. $636/wk NJ; and
- you appear to be employable so it is unlikely you'll be unemployed long enough to take advantage of claims in two states - and, when you are reemployed, will earn enough in NJ to qualify for a full claim again.
In the end, only you, OP, can weigh your employment prospects and decide if it is worth it to you to try for the lower TX benefit at this time. I suspect you'll find other work and, should that job end, qualify, again, for the higher NJ benefit. 26 weeks' work in NJ qualifies for a 26-week benefit.
In short, I wouldn't mess with Texas.
