My husband was laid off from his job on Jan 10th 2012. He was a territory manager who was paid a salary plus commissions. His company has agreed to pay him his commissions due for the next 45 days on regular company payday's this is on sales he made prior to being laid off.

My question will this effect unemployment max of 450.00 we get here in California ? We have been trying for weeks to talk to someone live at Unemployment office in California and no luck even getting thru. I can't seem to find this answer anywhere.

He MUST report ALL income and his payment might/will be delayed when they calculate the commission by the amount. How much are we talking here? If he pulls in $450 a week and the commission is $1,000, let's say. They would with-hold 2 to 3 weeks...

I would accept no advice unless it came from someone is this situation and in your state. My first thought is that in AZ an employer is required to pay all sums owing within 3 days of termination, so I'm seeing a wage claim issue.
