Hello I need help, UI wants all moneys back from time I quit my part time job!!
(They have No record). Appx 8000.00
I know I talk to UI service center about it he took all information including my other job (casual employment) information and said I would receive determination letter would be sent in mail, Never received anything till monetary determination was done to go on tier 1 There was no where to put it on bi-weekly forms because I was working a another part time job (cash casual employment) and had to state my other earnings
Do they RECORD ALL CALLS or is it my word against there’s? I believe they record all appeals but I’m not there yet.
Can they charge me with fraud 2nd degree misdemeanor?
Any ideas what should I do? What would happen I don’t have any moneys?

Did you have a record of the date, time and name of person you spoke with?
There was no where to put it on bi-weekly forms because I was working a another part time job (cash casual employment) and had to state my other earnings
Did you ask the representative how to complete the forms? "No where to put it" is not an excuse. If there wasn't enough room on the claim forms, you should have attached an addendum.

I do not know if PA records all calls. I do know PA is a complete mess these days on almost all issues, so your call "fell between the cracks" which is pretty much par for the course, especially since your issue required review. At the very least, your benefits should have been suspended, pending review. Clearly, your case was not reviewed. That said, it is your word against theirs. Not good for you unless you can prove otherwise.
Can they charge me with fraud 2nd degree misdemeanor?
If they resume paying benefits, PA might at that time issue a penalty waiting period based on fraud. 2nd degree miseameanor is unlikely.

You need to appeal this determination in writing detailing clearly exactly what happened and when. As I recall from your other posts, you had obtained another job to replace the one you quit. Clearly mention this in your appeal. It will take a few months for a decision because PA is very much behind in its processing. However, it is in your best interests to document exactly what happened.
What would happen I don’t have any moneys?
If you lose your appeals, your only recourses are:
1) ask for a waiver of repayment due to hardship;
or, if that is denied,
2) set up installment payments for repaying these benefits;
