Hi, just wanted to light the info on to what the law is for Poway Apartment Rent with you if anyone know something about it. Here's what happening is that we found a nice 2 bedroom apartment with garage online, that we were from the midwest. And then we got that apartment after we moved back to San Diego October 2010. Over a year later, got a notice from the property managment that we all the tenants have $100.00 raised on our rents, regarding the GARAGE only. I feel that raising the rent that much more should be a law against that and wonder if there is whether legally they can do that and this sounds like they were just squeese every penny that can out of people, greedy! So, what do you think?

Re: Change in Terms of Tenancy

Dear....

We have always endeavored to give you a quality living space at a fair. To that end we have not raised our rent levels in several years. However, due to increased expenses and necessary reserves for future repairs that we are anticipating, we find it necessary to invoke a modest increase in overall rents.

We have surveyed other apartments in the Poway area and find that none offers an enclosed garage included in the rent. We also surveyed various storage units in the area and find that one similar in size cost from $150-$250 per month each. We feel that the garage convenience is a definite perk to our tenants make it less costly for you because you do not have to store your toys and valuables offsite.

We do not intend to raise the rents equal to the value of the storage units. We only intend to raise your rent by $100 per month, beginning July 1st.

We will give you a couple of options to choose from:

A. Accept the rent increase and begin paying the rent on July 1st
B. Do not accept the rent increase and give up the garage as of July 1st. Your apartment rent will stay the same and you will have only one onsite uncovered space. We will rent the garage to an outside party or another tenant.
C. You do have the option to give a 30 day notice by June 1st and vacate by July 1st

Based on market research we realize the advantages and values that exits at the CCA Apartments over the apartments in the area. We will work with you to accommodate your needs. Please feel free to speak with our resident manager, about the options. We value your residency and hope you will stay.

I'm not aware of any sort of rent control in Poway.

I think they can do what they want to do, since it only involves the garage. There are other places advertised that also charge extra for a garage. They gave you three options, so you get to choose one of them.
