Any legal eagles that can walk me through the process of taking someone to small claims court. I have NEVER done this and probably will never again.....but this is more to stop harassment than getting funds returned. Don't ask specifics as I would have to violate TOS rules to explain.

Help?

I usually find that it's not worth it in the long run...even if you do get more money back than you would've if you didn't. No, I never personally took anyone to court, but have considered it sometimes when clients don't pay.

Since you provided no case details or even if you are the plaintiff or defendant, here is some advice.

Dress well, get there early, and act credible and seem believable. Bring any notes that are relevant to the case. If necessary, bring a witness but only if they are a direct observer to your case. Expect at least half a day since the cases will probably be backed up.

johnson...would the details make a difference? Since I'm suing, doesn't that make me the plaintiff? If the details make a difference, then I can PM this info.

Do I have to file anything first? Make a court day appointment? I have everything documented.....but do I just show up at courts (which one)....and tell the judge my complaint? Doesn't the defendant need to be there to have due justice?

What i alwyas found was that you may get a judgemnet but then trey to collect.Of course it is aseily appeal for a slight fee too.

It doesn't seem to be all that hard given you can prove your situation reasonably. After reading this I have the theme from the People's Court stuck in my head. Ugh.

My renters had to sue their former landlord in small claims court for their deposit.

They said it went very easy, that they brought proof (photos) of the condition of the house when they left, and they won the judgement without problems.

Having never used it before, I was amazed at the ease they said it was to actually be able to use to regain the money they were owed.
