I moved out of my room in a student complex last month. I completed a walk-through so they could tell me if there was anything majorly wrong with my room or the apt so I could rectify it before I moved out. There was a stain on my carpet that I had tried my best to get it, but it was still there faintly. It's a spot. I ask about this specifically during my walkthrough. The staff member informs that at the most I will have to pay for it to be spot cleaned. Cost: $30 according to their made up fee book.

Anyway, I was waiting to get my deposit back minus the spot/carpet cleaning fee. I get a letter saying I'm responsible for replacing all the bedroom carpet as well cleaning the living room carpet (which is split between all roommates)and they'll be keeping the deposit. I went through a walkthrough so they could bring these things up BEFORE I moved out and I could rectify it.

How do I approach this? I could just pay, but I personally feel they should've let me know beforehand. Isn't that the point the of admin walkthrough?

Write them a letter detailing the walk-through and demanding your deposit return.

No positive response small claims court.

This presumes normal rental laws with a lease. Colleges may have this wired so you can't pursue them directly. May have some school procedure.

Do you have the results of the walkthrough in writing?

After the walkthrough were you given a completed checklist or anything at all in writing confirming what the staff member told you? Even if you didn't, I would definitely get in touch with the company and explain to them exactly what happened as you've related it here. You didn't say what exactly they're planning on charging you but they can't charge you for the whole cost of new carpeting. Carpeting like everything else depreciates with age and there are standard depreciation tables out there (I know they've been brought up here in this forum so probably someone will have them).

Also, they cannot just arbitrarily tell you they're keeping your whole deposit but are legally required to itemize each deduction and provide professional estimates or actual receipts for work done. You'll probably find your state landlord tenant laws listed in the first "sticky" on this forum so go through the section which deals with return of security deposit for details applicable in your state.

I'm going to write them a letter detailing the walkthrough. They compared the checklist from when I moved in to when I moved out and the only thing of note was the carpet stain. Which I acknowledged and asked how it would be handled, and agreed to pay for the spot removal.

I'm tempted to dispute the living room. I had 3 leases in this complex, they clean the carpets before every semester. This is standard and done for every single unit. The living room was hardly ever occupied and the carpet was fine. This is not owned by the college, it's just made and marketed to students.

Did the person sign the walk through checklist and date it?

In most states the value of the carpet they replaced has to be pro-rated. i.e. they cannot charge you with the full replacement cost as normal wear and tear devalues the carpet every year the property is occupied.

Also most states have a time limit on how long they can take before they provide you with a written itemized list of deductions from your security deposit. If they miss that deadline they are entitled to nothing. Find out what your state laws require by consulting the sticky thread at the top of this renting forum.
