I rented a room in my 3 bed house to two women. They sign a 6 month lease which was sing December 18 becuase they moved in 2 weeks before the 1st. Which started Jan 1 2013,they payed jab rent late but payed it full, on the 12 they let me know they where no longer going to rent the room am giving me a 30 days notice. They gave me a written notice which i wrote on sayin they broke the lease. I also discussed with them on the 14th to infom them once again they will be breaking the lease it seem like they didnt care or didnt want to hear it. They inform me they will only pay feb rent until the 30th of their notice wich was half of 700. I gave them a written copy stating in detail what their doing breaking the lease n the money they owe n are responsible they did not want to sign it sayin they receive a copy so i took a picture of that n sent it to their phone they received it. Now what i want to know if ofcourse i can take them to small courts claim which am doing n want to have them serve b4 they leave.What other thigns can i do ? Can get a 3 day evection notice ?? since they only payed half of februarys rent?

What does your leases say, or did you sub let it.

Almost sounds like you are not the owner of the property...

they will owe you for monthly rent, on the due date, until you rerent to someone else. you can evict for nonpayment. But if they are moving out, the eviction expense does not make sense for you.

sue them in small claims court for the monthly rent they owe until a new renter moves in or until their lease end date.

They dont have to sign anything that says they are responsible for the rent. THEY ALREADY DID...the lease!. If you didn't give them anything releasing them from the lease, then they still owe money per what the lease says.

You must try to rerent if you are to keep charging them rent. if you take it to court to get back rent, then you want to have proof that you tried to rerent (classifieds , craigslist, sign, real estate listing, whatever you typically use to find a new renter)
