Even Judge Judy will tell ya to consult the family courts if he's not paying. You don't need the IRS on yer butt in addition to other stuff.

You can claim him only if you provide 51% of HIS living expenses.

If you are the custodial parent- why aren't you claiming your child anyway? Unless you don't have any income that year and can't file.

No kidding. We share custody, but my son lives here 5 days a week, and I claim him for tax purposes.

The only way I'd allow him to claim your child is if I knew Child Support was going to garnish his tax return for non-payment. That way there would possibly be a larger amount you will receive.

Have they started the garnishment process yet since he hasn't been paying?

I have a friend who's ex refuses to file taxes because he knows if he does they will take every last cent! What a jerk. He might as well file just to lessen the amount he owes- it's not like he was expecting money back then they took it by surprise- he KNOWS he won't get anything since he is in arrears yet he still won't file.

They are some real *men* out there I tell ya. I don't know why CSE won't just throw him in jail!

If you go and apply for cash aid assistance, they will take it right out of his wages. I know this from experience. You can also go to the local child support office with all documents necessary to show how much he's supposed to be paying, and they then too, will make sure it comes out of his wages. If he quits his job or finds work 'under the table', not only will they then suspend his license and take his tax returns (for non-payment), but he will have to prove he's caught up before he gets any of that back.
Then again if he chooses not to pay, it just proves how much he cares for the kid(s) by not supporting them.
