Closed a short sale yesterday. Home next door to me. Owners had moved across the country several years ago and their deadbeat (One foreclosure and a no pay rent to mom deal) tenant who made it almost impossible to show. (Buyer actually saw the master bedroom for the first time during the walk through).
Battled the bank for cash for keys for the tenant. 1st offer, they don't qualify. Second offer, $500. I finally got them $3000 to move! Tenant tells me one day before closing, she can't possibly move out, but wants her check. I try to get escrow to deliver the check to me so I have just a bit of leverage to help her move. She has mom write a letter to escrow saying don't give the check to me.
Buyer comes by the office this morning looking for keys. I have none. I suggest she give the tenant a rental agreement for one week at the same time she gives her a 3 day pay or quit. Should be interesting.
Next phone call she calls me a "shyster". Tenant has been taking paralegal classes online, so I hope she knows the definition.
I will never, ever make an attempt to help a tenant with CFK again.

Sorry, but I don't understand why you helped the tenant in the first place? Usually tenants who make no sign of being worried when served with the foreclosure papers have not much good up their sleeves since the good and honest tenants will be very worried and will show an effort to move.

Since your not licensed nor qualified to be giving legal advice, its in your best interest to refer the buyer to a good lawyer to get the tenant out. Your not doing the buyer any favors by giving them bad advice.
If you would just "pay your fair share in taxes" and support aid for these disadvantaged folks, these issues would not exist.
