My neighbor insists on burning his yard waste,and it chokes us at the same time.What are the laws regarding burning of yard waste(leaves,plants,branches).There is trash collection in the subdivision,and this stuff can easily fit into a couple plastic bags.To top it all off it is being burned within 50 feet of my house!.TIA.

What city and / or county are you in? Yard waste burning laws vary depending on where you live.
If you are not within a city limits and not in a HOA then there probably is no regulation on burnings.
However I would contact your local fire department (it probably volunteer fire department. to verify if there is any restrictions but it probably just the type of waste to be burned. Also there may be a ban if it windy or dry conditions. General is that it is allowable if there is no yard waste pickup.
You must be relative new and wasnt here when there was a wildfire in north eastern NC and the smoke due to the wind direction blew from the eastern North Carolina to the Piedmont as far as the Charlotte area.
Our neighbor does this too...drives me batty. He was even burning leaves during the worst of the drought last year. I was terrified that he was going to set our houses on fire.

I always thought that during the drought there was a temporary ban on burning yard waste? In some counties, you have to get a permit, as well. Don't feel that you are being a tattle tale but if your neighbor is burning his yard waste and it goes out of control, you are in danger. I'd contact the closest Fire Dept. and ask some questions!
My neighbor also likes to burn yard waste, and have a fire pit in their back yard just for that purpose. Every now and then the wind blows the smoke over toward my house. Oh, well, at least they don't do it *that* often.
Yes, start with the local fire dept and ask them about restrictions and code for burning. The area needs to be properly prepped, there are restrictions on what and when you can burn, etc. You will not likely get them to stop, but you can at least limit it and ensure its safe.
