She wasn't stopped because she was driving erratically. She was stopped for another reason.

And it's perfectly legal to drink and drive as long as your blood alcohol is under 0.08....and hers was.

Good question. I guess the officer smelled alcohol. Maybe the police felt she failed a field sobriety test. Maybe they felt they had to because her daddy is famous. It would seem unlikely that she will be prosecuted, not with a .06 blood alcohol.

Ah no, it is not "perfectly legal" to drink and drive as long as you blow less than .08. That is simply the threshold at which it becomes a per se offense that requires no further extrinsic evidence -- which can be used to charge/convict someone of DUI even if their BAC is below .08.
