I'm watching the show First 48 on A&E and I'm amazed at how these knuckleheads go down to the station and are interrogated--even though the police sometimes don't have enough evidence to charge them. I'm glad these knuckleheads are being taken off the street but why in the hell do they talk to the police.

But the only way people can know that is by referrring to one of those cards that are handed out by the ACLU explaining your rights in a police confrontation.
On the subject of the 5th Amendment, i find it morbidly amusing, better yet, highly ironic, that it doesn't apply while filing a 1040 or the likes in which an article and entity can be used for incrimination against said filer .
"Presumed innocent until proven guilty" is not a constitutionally guaranteed right. It is a convention that has evolved. It is not actually applied. Just ask people who are sleeping in county jails tonight, unable to make bail, waiting for their next coure apparance. If their trial date is a month from today, they have already been sentenced to serve 30 days. They can bribe the jailer to let them out, and the judge specifies the bribe.
What if you say to a judge "I don't have time to attend my trisl. Give me a call if I'm found guklty. I don't feel like watchng the prosecutor try to prove my guilt. Anyway, that would be impossible for him to do, since I am innocent."
Even on a lot of little things. I am presumed guilty of driving a mechanically unsafe car, unless I have a mechinic make an inspection that proves me innocent, at my own expense.

Yes, it is applied. You don't understand the purpose of bail. Bail is a contract that you'll appear in court, and not flee, causing the expenditure of time, money and resources to locate you.

Why does a person who is presumed innocent need to appear in court? Why do they think they need to locate somebody who is presumed innocent? Why doesn't the prosecutor have to post bail, so they don't have to go and look for him to make him come in and prove the guilt of the person presumed innocent?
