The conduct, then, was in the defendants' scope of employment regardless of whether it was unlawful or contrary to the national security of the United States...

Interesting concept. So long as one is acting within the scope of employment, breaking the law and breaching national security are perfectly okay. I wonder if there are any other circumstances under which this concept might apply...
