I get where you're going with this but your argument assumes that every state delegation will vote along party lines. Not saying it won't but it's not guaranteed either. If the vote moved to the house it would only take 1 defection to tie and 2 defections for Biden to win.

I think, given the chance, Republicans would rather negotiate with Biden rather than work with Trump. Let's face it, Republicans worked with Trump for the sake of the party not because they believed in him. With all the "drama" going on over the election, it sure has been quiet for Republicans outside the Trump circle.

If the state doesn't have a law on the books regarding duty of its electors, then it's time to write one. Some states allow the winning party to designate who will be sent as electors so there is less chance of a faithless one.

This election and the inevitable Supreme Court cases will solidify the need to have all election law on the books, made by the state legislature (as per the Constitution) and eliminate any of these on-a-whim changes or deciding to just rely on "how we've always done it."
