BBC News - Living Ohio man Donald Miller ruled 'legally dead'

He is living, but legally dead.
But wait; if he is legally dead, can a police officer give him a ticket?
What a legal can of worms! Exactly what are the rights and responsibilities of a legally dead person?
If somebody kills him, can that person be charged with murder?
How can one murder a dead person?
It could be a lot of fun testing the parameters of what a dead person can and cannot do!
Then again, it could be a real PITA!!

The poor chump really doesn't want to be a zombie. He's trying hard not to be dead, but the judge says he is, so he must be dead.

I have a friend who once was declared dead. He showed up 3 years later, very much alive and very screwed up in his head. The court finally said he was alive again, but all his friends call him Dead Bob anyway. He once said it's very hard for a dead guy to buy a car on credit, even when his bank account is good.

An interesting situation. I must admit, on the one hand I am rather satisfied that he shall find 'life' difficult for a while, for basely running away from his wife and children almost thirty years ago*. On the other hand, if he were declared 'alive', it would probably cause financial problems for his wife, since she had collected some spousal benefits. I imagine that a higher court will find a way to declare him alive, and that the 'overpayment' to the spouse will be excused.






*It is in The Adventures of Oliver Twist that we find Mr. Bumble, who had married a woman who was not, as it turns out, a very agreeable person. At one point the harrassed Mr. Bumble learns of another gentleman who had run away from his wife and children, to parts unknown. While others were condemning the action, Mr. Bumble privately thought that the man showed unusual courage, and should be given a medal or such for his action.

so..hypothetically speaking...

if the brother of the woman he ran out on, decided to beat the living bejebus out of the dead guy, could he be charged?

is it a crime to assault a dead guy?

Hmm. Most states have laws against abuse of a corpse. Perhaps that law would answer.

He's basically an "undocumented person". He should move to California, where he can get a driver's license and enjoy a host of other freedoms.

But he's not a corpse yet! He's only dead! Do any states have zombie laws?
