There is a difference between the metadata, which says phone A called phone B and the tapped conversation. Authorization for the former exists and many current members signed it. The latter still requires a warrant, and the legitimacy of that is up for debate. But the most common thing I see is people conflating the two which makes it hard to follow what people are arguing. Nothing NSA gathers is admissible, its for intelligence not prosecution

Never forget that laws like Occupational Safety were signed by Nixon. He was more like some of our establishment liberals than he was like Gingrich or McConnell.
