An EO order like that would be turned over exceptionally quickly, like within 24-48 hours. Justice moved slowly most of the time, but it will protect against a huge over reach like that. I am not worried at all about an EO taking guns away from people. The Feds don't have the votes for meaningful gun legislation. It is the state governments I am worried about. Hopefully the next SCOTUS ruling sets a standard of scrutiny. Another gun case should be ruled on by SCOTUS in 2014.
The difference is the only thing stoping Obama from doing that is congress. If he had his way he would be confiscating "assault weapons" but it is not politically fesable. Plus Obama cannot aother bills, that is the job of congress.
If Obama really wanted to bring back the assault weapons ban, he had a golden opportunity to do it when the democrats had both houses, he never did.
