"he cited immigration laws from the days of slavery, something else that shocked commentators."
Here are his words, which right wingers will claim are taken out of context
Quote:
Notwithstanding "[t]he myth of an era of unrestricted immigration" in the first 100 years of the Republic, the States enacted numerous laws restricting the immigration of certain classes of aliens, including convicted criminals, indigents, persons with contagious diseases, and (in Southern States) freed blacks. State laws not only pro*vided for the removal of unwanted immigrants but also imposed penalties on unlawfully present aliens and those who aided their immigration - Scalia
Ahhh, another race baited thread that failed before it evn begun.
he cited a law dealing with FREED Blacks.. Thats not slavery, thats anti slavery
Agreed. That's a FAIL. Then again, what else should one expect from the NYTimes, the same newspaper that employed moral reptiles like Walter Duranty and Herb Matthews who covered up for the murderous Stalin and Castro regimes respectively, or fools like Paul "The Govt needs to lie about a alien invasion to justify more spending to stimulate the economy" Krugman and Thomas "If we could only be the murderous Chinese Communists for a day" Friedman.

Both slaves and free Blacks, were not citizens, which is a bitter and shameful part of our history. I can esily see why it was in poor taste and "judgement" to bring this up.
Scalia reminds of the bat crap crazy judge in "And Justice For All" with Al Pacino.

Avoiding our history, does not make it go away. Face it and have a backbone.
History sets precedence in the future, unless your ignorant that it ever happened and moving on a path to repeat it once again.

You right wingers will twist the truth anyway you can. Yes, it's about freed slaves, but he was justifying a state passing anti-immigration laws that restricted immigration of freed slaves (and convicted criminals, etc) as support for Arizona restricting immigration. He was equating the two in defense of Arizona's law. I.e., if the southern states could restrict former slaves (read- black people), why not let Arizona do its thing.
