Shame the rooftop bar if of the plan - Philly could really use one

Was In Chicago last weekend and although may not be totally my scene this Doubletree offering seemed very nice (only in lobby and rooftop bar/lounge) and far hipper than the marriott I was staying in accross the street (damn points)

The Pennsylvania Commonwealth Court just tossed out the Philly Court's decision about Fergie's tower.

Michael Singer and William : R. Piper, Jr., v. Philadelphia Zoning Board of Adjustment, City of Philadelphia and 1213-1219 Walnut Associates

HONORABLE BERNARD L. McGINLEY, Judge, HONORABLE DAN PELLEGRINI, Judge, HONORABLE PATRICIA A. McCULLOUGH, Judge

OPINION BY JUDGE McCULLOUGH

FILED: September 30, 2011]

AND NOW, this 30th day of September, 2011, the August 5, 2010, order of the Court of Common Pleas of Philadelphia County is hereby reversed.

Commonwealth Court basically said that there was nothing special about the project, so the development had to follow the law just like everyone else.

  • Brief Recap-
Round 1) The Dept of L&I denied the application because it violates zoning requirements about density, parking, loading zones and restaurants. The Developer appealed to the Zoning Board.
Round 2) The ZBA approved the applicaiton, saying it was clear that the project met the legal criteria to bend the law. The neighboring businesses appealed.
Round 3) The Philadelphia Court upheld the variances, saying it was clear that the project met the legal criteria. The neighboring businesses appealed again.
Round 4) The State Court reversed. They found that it was so clear that the project did not meet the legal criteria that they were taking the case away from the ZBA and Philly Courts and deciding it themselves.

the cursing in that blog seems so forced. i just imagine some 60 year old guy with an architecture blog hoping that throwing in a curse every other word will make him cool.

despite it's attempt to be ridiculous. some decent information there.
