They are garnishing my wages for my student loans. Also, they told me that they will take my money from when I file my taxes every year. My question is, when they take my money from my taxes do they take both federal and state or just from one? It was not a state college. Also, if I get married and we file separately, will my husband be affected by my loan in any way? I don't think so, just want to make sure.

I would assume all your tax return is a goner. State and federal.

Keep in mind, it doesn't change the amount of tax you paid to the federal and state governments. This amount stays the same. They are taking your tax refund. In regards to whether it is the state or federal refund, then that will depend upon who owns the loan. It doesn't matter where you went to school.

In regards to marriage, it depends upon state law, but in many places, the spouse can be held liable for the debt acquired by the other spouse before the marriage. It won't matter how you file your taxes. You will need to check with local laws. You should just have a goal to pay it off, like all debt, as soon as you can.

Why are your wages being garnished for your student loans? I have student loans that are on a deferment. My wages have neve been garnished, nor have they kept my tax returns. I keep in contact with them every year as to my repayment status. Unfortunately, I haven't been making enough money to start paying on them. I'd like to be able to, because I can claim the interest on my tax returns.

Talk to whoever financed the loans, and see if you can get a forebearance or deferment. There are several different kinds.
