Act 189 expanded the retroactive sections under the Uniform Planned Community Act (UPCA) for planned Communities in PA. Section 5102 B1 made section 5303 b retroactive and that section states that members of communities established before Jan 2005 have the right to vote on their budgets as long as it doesn't violate their declaration or bylaws written before Jan 2005.

This is a powerful option for members to control their budgets and to have a say on their future. Also keep board members that like to spend your money under control.

Default Is your PA association breaking the law?

All PA associations have to address section 5303 b of the Uniform Planned Community Act (UPCA). For planned communities that were created before Feb 2,1997 you have to look at the by-laws to see if voting on the budget (operating and capital) invalidates any by-laws written prior to this act. Any new by-laws written after the act took effect, they must comply with the UPCA. Do not allow your Association leaders take your rights away.

Can a few people in a community start a uniform planned community act 68 section 5301 when all the lots are sold and building started in 1967? They try to control the houses being built and charge people who own land that can't be built on.
They set up a tax exempt corp in 1990 after all the land sold and started taking people to court to make them pay.
