Hey, y'all.

Here's the most recent update on this mishegoss with my former landlord.

Remember that the first letter and set of photos that I sent him via certified mail were returned unclaimed? Well, last month, I re-sent the letter and photos--again, via certified mail, return receipt--and they were signed for. I told him that he had two weeks from the date of his receipt of said letter and photos in which to return the portin of my security deposit that he'd improperly withheld. It has now been more than two weeks, so I'm going to file against him in landlord/tenant court.

I have one question, though, that perhaps some of you who are better versed in these matters can answer for me.

The form asks you to fill out the amount for which you're suing, and the reason why you're suing. I entered an amount that represents (a) double the security deposit because he didn't return it within the 30 days that he was required to do so, and (b) double the portion of the deposit that he improperly withheld, and I indicated as much in the appropriate fields on the form.

Here's my question: Did I do this correctly? I mean, the ******* did eventually return the deposit, minus the amount that was improperly withheld--even though he returned it AFTER the 30 day limit--but am I allowed to add that amount to my suit, or am I allowed to sue only for double the portion of the security that he improperly withheld?

Thank you for your help!
