Hi,
I am new to forums, I need help from the people who faced the similar situation. I living in a renting house in jersey city heights. When I moved in I didn't know all the rules. Now I am little bit scary about my owner and my security deposit. I gave 30 days written notification already.The paint from the ceiling is falling down. I told him two months back. I have one week time to vacate. yesterday My owner wife came with some give guy to get estimate for the entire house for painting. Entire house painting looks good now. I am thinking that they may use my security deposit to paint the entire house and give bill to me. I don't have any pics taken immediately after I move in. But I can take pics when I moving out to show the house painting is good.If he cuts more money from security deposit and if I go to small claims court, How Can I prove this? Did any body faced this problem.

I dont know if things are different now, but back when I used to rent (10 years ago), I never, ever, ever got a full security deposit back. In many cases, I didn't get ANYTHING back, even though I left the place in better shape than I found it. I came to look at the security deposit as the cost of renting a home. I know this doesn't help you out too much, but expect them to pay you as little as they can possibly get away with, and then you wont falsely get your hopes up. Then, if they happen to give you the whole thing back (will never happen), you will be pleasantly surprised.

They cannot charge you for painting if you lived there for 2 years or more.

I Have a written lease, but it was completed, I gave 30 days notification also. He signed and gave one copy to me.If he give me very less money, Can I go to small claims court? If so what I have to carry with me.

I think he supposed to put, my deposit in a bank and should mention in the lease, But he didn't mention any bank details about my security deposit? Is it Illegal

You are correct. Your security deposit should have been put in an escorow account(if he rents 5 or more units I think), but at this point its not worth going to court over IF he gives you back all of your money. Make sure he is giving you a check when you turn over the keys to the apartment.
