If no medical attention was needed. they shold not have a case. The judge will frown on them for not seeking medical attention at the scence. I think you will be able to fight your way through this case just fine.

Generally, the defendants insurance is going to cover damages awarded by court to policiy limits. This is why you really should have much more than the required minimum coverage. Personal injuries and property damage can add up very quickly and it does not take much to reach policy limits in a serious accident.

In order for the court to award damages, the plaintif would need to show that damage did occur and defendant is liable. If you are being sued, you should contact your insurance agent as they have interest in outcome. You may also need a lawyer.
