My husband removed my name from our home mortgage when he refinanced. My
name is still on the title. Is this legal?

Usually, yes. But you should ask a lawyer in your home state. It can be a problem for the bank, but it was their choice. It is not really clear how he could have "removed" you name from a mortgage though. I you mean he just took an eraser to a copy of the mortgage, that is meaningless. If he refinanced without your name on the mortgage, he did not remove you name, he just refinanced without you. Depending on your state law, the mortgage may only attach to his interest in the house, not to yours.

I understand what you're saying, but wouldn't there be two mortgages on the property if only his half of the house is attached? I honestly do not understand how that would work. Yes, he did refinance the house, rolled a $15,000 loan into it and informed me that he took my name off the mortgage. Does that mean I am not responsible for repayment? Is what he and the bank did even legal in Michigan?

Are you worried he might try something? Generally the title has nothing to do with financing. Also most states consider property attained during a marriage common property with or woth out title names. So tell your hubby he can't pull a fast one even if he gets with that 20 something from the gym.

You may not be responsible for repayment, BUT how long will you be there if he stops making payments? Possible he thought your credit might not matter or hurt the re-fi?


WAIT...are you saying he re-fi'd WITHOUT your knowledge?

If that is the case, you might have more to be concerned about than the title of the house.

If I recall in Michigan a wife's name has to be on the title for whatever reason. As for removing your name during refi I know nothing.
