My husband and I are interested in purchasing a specific piece of property (land only) that is for sale by owner in western ME near the NH border. Since we won't be working with a realtor, where can we get a contract Purchase & Sale form so we can submit our offer to him? Would I have to go through a real estate attorney in ME? Can I get the contract form from a public library? Can anyone recommend a good real estate atty in ME for this area?

Liens are always a concern.

ALWAYS have a title search done by an attorney specializing in title issues. Then buy title insurance. You want to be sure the property is actually owned by the seller, the taxes are paid and there are no liens on the land. A quit claim deed by the seller is OK only if you buy title insurance. If the property is not on a public road make sure you have a deeded right of way for all purposes to the property.

The sample Purchase and Sale agreement above does not show the book and page of the property to be sold. That is a critical feature that must be included. You could be buying only one lot of multiple lots the seller bought in one transaction.

When I bought land in Maine, I used a land transaction lawyer.

He charged me $200. [Which I see is customary in Maine. Previously I have spent much more when buying properties, if you spend $5,000 everything above the first $200 excess profit gouging.]

He handled the escrow, the deed, and the title insurance.

I can give you his name if you want it.

Allow me to modify what I said.

The lawyer that I used is located in Medway, and Lincoln.

From talking around, I have heard that his fees are about average. You certainly may contact him, however where you are focusing on buying is likely outside of his normal area.

I would recommend that you contact a 'Land Transaction' Lawyer in the Western Maine area.
